Verdicts and Settlements

Most cases are settled before trial, although it often is necessary to file a lawsuit to cause the insurance company to take the claim seriously.  Many times insurance companies offer only to pay medical expenses, making no allowance for the way the injury has reduced the quality of a person’s life.  We have successfully tried and settled over one hundred personal injury claims ranging in amounts from twenty thousand to over one million dollars.

A representative sample of the type of cases and their results is listed below:

$1,020,000 – Medical Malpractice Case

A five day jury trial resulted in a $1,020,000 verdict in a medical malpractice case against a urologist for the negligent placement of a penile implant.


Confidential Settlement – Product Liability Case

Claim against Bridgestone/Firestone because of tread separation of a rear tire on a Honda Passport.  The car flipped while traveling down I-75 and, although seat-belted, a passenger’s head was drug along the roadway causing facial lacerations and a traumatic brain injury.  Representatives from the tire company’s Dayton, OH headquarters met in our offices, and after reviewing our evidence paid a confidential settlement amount to resolve the claim.


Confidential Settlement – Medical Malpractice Case

We represented a woman suffering from fainting spells who was taken to Wellstar-Kennestone Hospital in Marietta for observation and a medical work up.  When she presented to the hospital she met all the criteria to be placed on a “risk-to-fall” protocol.  Unfortunately, her chart was not correctly marked, and the nursing staff did not take the proper precautions.  She fell on her third day of admission and struck her head causing a subdural hematoma which required brain surgery to correct.  The hospital paid a confidential amount to settle the claim after a one day mediation.


$1,200,000 – Liability Case

Represented a mother and her one year old child who were rear-ended by a tractor trailer truck.  The child died in the wreck.  The company blamed the Georgia Department of Transportation for failing to properly mark highway construction.  A lawsuit was filed against the company that owned the truck and employed the driver.  Just before the case was tried to a jury the company asked that we enter settlement negotiations.  Following a one day mediation the trucking company agreed to pay $1,200,000 to fully compromise the claim.


$955,000 – Medical Malpractice Case

A medical malpractice case against Kaiser-Permante resulted in a $955,000 verdict for the negligent manipulation of a ureteral stone and poor post operative care resulting in the loss of a kidney.


$1,000,000 – Auto Accident Case

Represented a teenage boy who suffered a fractured back in an automobile accident.  The case settled for $1,000,000.


$1,000,000.00 – Medical Malpractice Case

Represented a woman who was operated on to relieve abdominal pain.  The surgeon failed to properly divert the woman’s fecal stream leading to an extended hospital stay and multiple additional surgeries.  After filing a lawsuit, completing discovery and stipulating the case to the trial calendar, the surgeon settled the case for $1,000,000.00.


$100,000.00 – Liability Case

We represented a woman that was struck by a Gordon County School Bus.  She suffered significant scarring and disfigurement of her leg.  Gordon County claimed the woman was at fault for walking in front of the school bus.  After showing the County that they were not following proper procedure with respect to loading and unloading students, the case settled for $100,000.00.


$180,000 – Car Accident and Liability Case

We represented a gentleman that was rear ended by a Georgia State Patrol Trooper who was speeding in excess of 100 miles per hour at the time of impact.  Our client suffered a torn rotator cuff.  The State denied the claim asserting Sovereign Immunity.  After defeating the State’s claim of Sovereign Immunity, following briefs and oral argument before a Pickens County Superior Court Judge, we settled the claim in a one day mediation for $180,000.


$900,000 – Truck Accident Case

Represented a forty two year old man who was hit on the driver’s side of his pick-up truck by another pick-up truck as he crossed an intersection.  He suffered a back injury that required surgery to repair a herniated vertebral disc.  The other driver denied any fault and we filed a lawsuit.  The case settled for $900,000 during mediation.


$500,000 – Medical Malpractice Case

Represented a 46 year old man who underwent a laproscopic chlolysistectomy (removal of a gall bladder).  The surgeon negligently ligated (cut and tied off) the hepatic duct instead of the cystic duct, interrupting liver function.  The mistake was corrected, but required an additional surgery.  When we presented the claim, the surgeon raised the medical defense that the error was “incident to the procedure”.   In other words, he claimed that the two ducts are so close together it is possible to confuse them without being negligent.  The doctor refused to pay any compensation.  We filed a lawsuit and the case settled for $500,000.


$500,000 – Auto Accident Case

Represented a young boy that suffered neurologic injury in a car wreck.  The case settled for $500,000.


$500,000 – Slip and Fall Case

Represented a 42 year old man that slipped and fell because of liquid that was allowed to remain on the floor of a business.  He struck his head and developed a post traumatic seizure disorder.  The condition was later controlled by medication, but he will probably have to take the drug for the rest of his life.  The property owner claimed the liquid was spilled immediately before the slip and fall occurred, and therefore, they were not negligent in failing to discover and clean it.  The company refused to pay any compensation.  We filed a lawsuit and the case settled during mediation for $500,000.


$360,000 – Insurance Claim Case

Represented a fifteen year old boy that was accidentally shot in the eye with a BB gun by his friend.  The injury reduced vision quality in one eye.  The home-owners insurance company that insured the home where the shooter lived hired a lawyer to resist payment on the claim.  The insurance company lawyer claimed that the shooter was too young to be held responsible for his negligent behavior.  We filed a lawsuit and the case settled for $360,000.


$400,000.00 – Motorcycle Accident Case

Represented a 23 year old who suffered a traumatic brain injury when a pick up truck turned left in front of him while he was riding his motorcycle.  The case settled for $400,000.00.


$255,000.00 – Tractor Trailer Accident Case

Represented a 34 year old mother of two who suffered a broken wrist and fractured hip when a tractor trailer ran a red light and struck our client’s minivan on the driver side.  After a one day mediation, the case settled for $255,000.00.


$340,000 – Product Liability

Represented a 50 year old woman that had a defective orthopaedic medical product placed in her hip.  She made a full recovery, but replacement of the prosthetic hip joint required a second surgery.  Suit was filed against the manufacturer of the medical device, and the case settled for $340,000.


$100,000.00 – Hit and Run Case

Represented an eighty year old woman that was struck by a hit and run vehicle while she was gardening in her front yard.  We were able to obtain $100,000.00 of Uninsured Motorist Coverage for our client from her own Insurance Company.


$100,000.00 – Bicycle Accident Case

Represented a man hit by a car while he was riding his bicycle.  The driver of the car attempted to pass our client, and hit him as she was moving past him.  Our client suffered facial fractures that eventually healed.  The case settled for $100,000.00.


$90,000.00 – Motorcycle Accident Case

Represented a motorcyclist that was injured when a Sports Utility Vehicle turned left in front of him.  Our client suffered various injuries including a torn hamstring muscle.  The case settled for $90,000.00.


$150,000.00 – Motorcycle Injury Case

Represented a motorcyclist that was injured when a vehicle turned in front of our client as our client was making a right hand turn at the intersection of Windy Hill Road and Cobb Parkway.  Our client suffered severe neck injuries.  The case settled for $150,000.00.


$120,000.00 – Dog Attack Injury Case

Represented a seventy seven year old woman that was attacked by a German Shepherd as she was walking in her neighborhood.  Our client suffered bite wounds to the arm and leg.  After lengthy negotiations with the Insurance Company for the owner of the dog, the case settled for $120,000.00.


Product Liability Case

Represented a woman who was injured when she sat in a defective chair.  Our client suffered shoulder injuries from her fall.  After a one day mediation, the case settled for a confidential amount.


$200,000 – Auto Accident Injury Case

Represented a 36 year old woman who suffered a knee injury in an automobile wreck that required surgical repair.  The case settled for $200,000.


$100,000 – Auto Collision Case

Represented a lady stopped at a red light who was hit from behind.  Although the collision was minor, one week before the wreck she had undergone back surgery to repair a congenital condition.  The slight collision caused her to have severe back pain for some period of time at the site of the earlier surgery.  She healed without further surgical intervention.  The case settled for $100,000.


$100,000 – Auto Accident Injury Case

Represented a 44 year old lady that was hit on the driver’s side of her car as she attempted to cross an intersection.  She suffered a broken arm.  The case settled for $100,000.


$80,000 – Premises Liability Case

Represented a 36 year old lady that got her shoe-lace caught in a gardening spike in the common area of her apartment complex.  She fell and suffered a twisted knee that required a surgical repair.  The case settled for $80,000.


$75,000 – PTSD / Biting Injury Case

Represented a three year old child that was bitten in the face by another child at a day care center.  Although the little girl did not suffer any permanent scarring as a result of the bite, there was psychological evidence that she developed a post- traumatic stress disorder that caused nightmares and insecurity.  The case settled for $75,000.
